FGD of RPP of Law No. 13/2018 on Submission and Storage of Printed Works and Recorded Works

Tugu Tani, Jakarta — The existence of the new Law on Submission and Storage of Printed Works and Recorded Works (SSKCKR) Number 13 of 2018 must be accompanied by government regulation (PP) as a reinforcement of the law that has been issued. The compilation of the urgency draft and the PP draft was seen in the focus group discussion (FGD) held by National Library in Jakarta, Wednesday (31/7).

On the first occasion of FGD, National Library invited a number of related parties, such as House of Representatives Commission X, Ministry of Law and Human Rights, Ministry of Education and Culture, Ministry of PAN-RB, and Ministry of Finance.

At the beginning of the discussion, a member of House of Representatives Commission X, Ferdiansyah, said that RPP of SSKCKR Law currently compiled was synergised with five laws, namely Law Number 5/2017 on Cultural Progress, Law Number 3/2017 on Book System, Law Number 43/2007 about Library, Law Number 13/2018 on SSKCKR, and Law on SisnesIptek.

There are five main points of discussion originally arranged in the compiled RPP, namely submission, management, funding, public participation, and award. "The draft text does not yet regulate the mechanism for the obligation to submit journal and reward or individuals who comply with the law," explained Ferdiansyah.

Meanwhile, delegates from Ministry of Law and Human Rights highlighted a number of procedures for the preparation of RPP. Has the permit for initiative been issued by State Secretariat? If indeed this RPP is not included in National Legislation Programme (Prolegnas) 2019, the RPP can be submitted the following year.

If it is not included in National Legislation Programme, KemenkumHAM offers two solutions, namely RPP is included in government drafting programme, or in the initiative test programme. That is, there will be a study, is there urgency draft? "If you already got an initiative permit, then focus on the substance," a representative from Ministry of Law and Human Rights explained.

Meanwhile, Ministry of Education and Culture suggested harmonisation with Law on Film considering that in SSKCKR Law there is a linkage between recorded works that must also be submitted.
